Participation Agreement and Release
This Participation Agreement and Release (“Agreement”) is entered into by and between the Fernandeño Tataviam Band of Mission Indians (FTBMI) Education & Cultural Learning Department and its agents (collectively referred to as “ECLD”) and the undersigned Participant, or the legal guardian of the Participant if under 18 years of age, as of the date signed below.

In consideration of the opportunity to participate in ECLD programs and activities, and for other valuable consideration, the undersigned agrees to the following terms:

1. Code of Conduct
The Participant understands and agrees that:
- The use of illegal drugs, alcohol, smoking tobacco, and weapons is strictly prohibited at all ECLD program locations and the Administration Office.
- Prescription medications may only be used as directed by a licensed physician.
- Tobacco may only be used in culturally appropriate ways. Ceremonial use (e.g., burning or smoking tobacco) is permitted only with prior approval from FTBMI and advance notice to ECLD management.

2. No Warranties
ECLD makes no warranties—express, implied, or statutory—regarding the safety, quality, or outcomes of any program, activity, or facility used.

3. Release of Claims
The undersigned voluntarily and irrevocably releases and discharges ECLD, its officers, staff, volunteers, funders, partners, and sponsors from any and all claims, liabilities, or damages arising from:

- Participation in ECLD programs or activities;
- Transportation provided by ECLD or third parties;
- Use of the Participant’s image, voice, or biographical information in media or promotional materials;
- Any distortion, alteration, or composite use of such materials.

4. Waiver of Unknown Claims
The undersigned waives all rights under Section 1542 of the California Civil Code, which states:

“A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.”

This means the Participant gives up the right to bring claims in the future, even if they were unknown at the time of signing.

5. Limitation of Liability
ECLD’s total liability for any claim related to this Agreement or participation in its programs is limited to fifty dollars ($50). ECLD is not liable for any indirect, incidental, or consequential damages, including lost profits.

6. Governing Law
This Agreement is governed by the laws of the Fernandeño Tataviam Band of Mission Indians and the State of California, without regard to conflict of law principles.

7. Acknowledgment
By signing below, the undersigned confirms they have read, understood, and agreed to the terms of this Agreement on behalf of themselves or the minor Participant.

The Fernandeño Tataviam Band of Mission Indians is a native sovereign nation of Northern Los Angeles County with historic ties to Mission San Fernando. Their traditional, historic, and ancestral tribal territory encompasses four valleys: the San Fernando, Simi, Santa Clarita, and Antelope Valleys. Today, the Tribal Administration Office is located in San Fernando, California.
